Four years after Krista Joiner filed for divorce from Xzibit, the former couple has been declared legally single.
On Monday, April 28, the rapper and actor’s request for bifurcation was granted and they were both “restored to the status of single persons,” according to documents obtained by PEOPLE.
Xzibit (born Alvin Joiner), 50, filed for bifurcation — which separates marital status from divorce proceedings regarding child and spousal support — on April 24.
According to the filing, the pair separated “over four years ago” and “in the present case, the parties’ marriage is no longer viable, and reconciliation is not possible.”
The pair — who share 14-year-old son Gatlyn — first entered a divorce in February 2021. They tied the knot in 2014.
A trial for the divorce was originally set for April 28 — but a new trial date has been set for June 16, per the documents.
“While I am hopeful that a trial on all the issues will be set in the very near future, in all likelihood it may take months for the trial to commence and longer to conclude,” Xzibit wrote in the documents.
He continued, “I no longer want to be married to Petitioner. I request that our marital status be terminated as soon as possible. Restoring Petitioner and I to single persons is in both of our best interests and will allow us to alleviate emotional strain and pressure and hopefully help facilitate settlement on all reserved issues.”
In the filing, Xzibit’s lawyer, Roslyn Esquire, also claimed she had not heard back from Joiner’s lawyer since April 7 despite multiple requests.
Attorneys for Xzibit and Joiner did not immediately respond to PEOPLE’s request for comment.
The new filings come after Joiner filed to modify her existing spousal support to over $21,000 and child support to over $9,000 from the rapper, per TMZ, in order to maintain their lifestyle. The outlet reported that Joiner and their son were forced to vacate their home because they could no longer afford the $10,000 rent and are struggling to cover other high-end expenses such as designer clothing.
Per the outlet, she is also requesting $300,000 in attorney fees.
Xzibit and Joiner tied the knot on Nov. 29, 2014, hours before the former host of MTV’s Pimp My Ride was arrested in Laguna Beach, Calif., for two counts of DUI, per ABC News.
According to The Blast, he pleaded guilty, served three years of probation and completed an alcohol education class before the case was closed.
In May 2008, the former couple welcomed a son named Xavier, who died days after his premature birth. Xzibit is also dad to Tremayne Marcell (known professionally as Tre Capital) whom he welcomed in 1995.
