- Derek Rosa is accused of stabbing his mother, Irina Garcia, 46 times on Oct. 12, 2023, and is now charged with first-degree murder, to which he has pleaded not guilty
- He allegedly took photos of his mother’s corpse after the killing, according to a motion filed by the Miami-Dade State Attorney’s Office and obtained by PEOPLE
- That motion also claims the killing took place on the eve of Friday, Oct. 13, because of Rosa’s alleged affinity for Jason Voorhees, the killer from the Friday the 13th franchise
A Florida boy charged with murdering his mother took a photo of her corpse and then sent it to a friend, according to prosecutors.
Derek Rosa was 13 when he allegedly stabbed his 39-year-old mother Irina Garcia 46 times as she slept in her bed in their apartment in Hialeah on Oct. 12, 2023.
Prosecutors are now detailing Rosa’s alleged actions in a motion filed by the Miami-Dade State Attorney’s Office and obtained by PEOPLE.
That motion alleges that Rosa documented the killing and told at least one friend about it before calling police.
“Shortly thereafter, the Defendant photographed his mother’s body in a pool of blood, along with a handgun. The Defendant also took a ‘selfie’ with his hand covered in blood,” the motion said.
Prosecutors said in the motion that less than 10 minutes after taking those photos, Rosa made the first of several phone calls to a friend in another state.
During that first conversation, Rosa allegedly told his friend that he would be sending photos and asked that the friend tell him what they thought, according to the motion.
Prosecutors wrote in the motion that Rosa proceeded to send images of his mother’s corpse in a pool of blood, a gun and his blood-soaked hand to the friend.
Prosecutors wrote in the motion that the friend initially thought Rosa was joking after receiving those images, and when he learned they were in fact real, the friend “alternated between shock and disbelief.”
The Oct. 12 date of the stabbing was significant, prosecutors allege in the motion. According to the motion, Rosa had a fascination with Jason Voorhees, the hockey-masked antagonist from the Friday the 13th horror franchise who often used a machete to kill his victims.
As first reported by WTVJ, prosecutors claim Rosa had said he would be going as Jason for Halloween in messages to friends prior to the stabbing, which took place just before midnight.

It was Rosa who reported the murder in a call to 911, during which he allegedly confessed to the crime and detailed his actions while speaking with the operator.
Police soon arrived at his apartment and took Rosa into custody, noting in their report that there were bloody footprints allegedly matching Rosa’s leading from the bedroom to the front door.
This new motion is in response to a defense request for discovery that prosecutors claim is an attempt to point the finger at Garcia’s husband, Frank Ramos, as an alternative suspect.
The husband was in Georgia at the time of the killing, according to prosecutors.

The victim’s newborn daughter was sleeping in the same room as her mother at the time of the killing, but was unharmed.
Rosa has entered a not guilty plea to the charge of first-degree murder, and a court hearing on the defense’s request to present Ramos as an alternative suspect is scheduled to take place later this month.
