Sean “Diddy” Combs is now facing five criminal counts related to his federal sex trafficking case.
The new indictment, made public by federal prosecutors in New York City on Friday, April 4, include one more count each of sex trafficking and transportation to engage in prostitution, per the indictment obtained by PEOPLE. The new charges are related to a second victim, the indictment states.
Combs, 55, was previously charged with three counts, including sex trafficking, racketeering and transportation to engage in prostitution, according to the indictment, which was first filed in September 2024.
The indictment centers around alleged “freak offs,” which prosecutors describe as “elaborate and produced sex performances” that the disgraced music mogul allegedly coerced others to partake in.
The indictment alleges that Combs and his associates would lure people under the pretense of a romantic relationship before he would use “force, threats of force and coercion” in order to get them to participate in the “freak offs.”
The new count of sex trafficking by force, fraud or coercion alleges that Combs “recruited, enticed, harbored, transported, provided, obtained, advertised, maintained, patronized and solicited [Victim-2], and attempted, aided and abetted, and willfully caused [Victim-2], to engage in commercial sex acts, knowing and in reckless disregard of the fact that Victim-2 was engaging in commercial sex acts as a result of force, fraud, and coercion.”
The additional count of transportation to engage in prostitution is also tied to allegations brought forth by Victim-2. The previous sex trafficking and transportation to engage in prostitution counts were only in connections to allegations from Victim-1. However, the racketeering case remains the same in the new superseding indictment.
“These are not new allegations or new accusers. These are the same individuals, former long-term girlfriends, who were involved in consensual relationships,” says Combs’ attorneys to PEOPLE in response to the new counts. “This was their private sex life, defined by consent, not coercion.”
Combs is currently behind bars at Brooklyn’s Metropolitan Detention Center as he awaits his trial on the federal charges, which is scheduled for May 5. He has pleaded not guilty.
He has also been named as a defendant in dozens of lawsuits accusing him of sexual misconduct. Combs has denied the allegations.
