An Ohio man allegedly slammed a 15-month-old girl on the floor after she wouldn’t stop crying, fracturing her skull. Two weeks later, she died of her injuries.
The man, Piqua resident Michael Mayor, reportedly attacked the toddler, Vivian Gardner, on Dec. 5, after a babysitter left him alone with the toddler and other kids while taking some of the children in her care to school, according to police records obtained by Dayton, Ohio, outlet WHIO.
Police and EMS responded to the babysitter’s location shortly after 3:00 p.m. local time that day after receiving reports about a toddler who was breathing but unresponsive, WHIO reported.
The babysitter said that the child was “pale, had bruises on her head, and she was unsure of where they came from,” police said, per the outlet.
She reportedly checked up on the toddler — whom she had left with Mayor, 34, earlier in the day — multiple times throughout the day, but became concerned when she had not woken up by 3:00 p.m. and was unresponsive when stirred.
As the last person with the toddler, Mayor was arrested and charged. He later admitted to police that he had injured the child when she wouldn’t stop crying while he was attempting to get her to nap, according to WHIO.
Mayor “stated he ‘shook’ her and when she cried louder, he began to ‘slam’ her on the floor of the bedroom,” according to a police report viewed by the outlet. He also told police that “this was not done on the blankets” and said he “did this several times until she stopped crying.”
At that point, Mayor said he thought Gardner had fallen asleep, so he put her down on the bedroom floor and walked away, WHIO reported.

After authorities arrived on the scene, the child was flown to nearby Dayton Children’s Hospital, where doctors informed police she had suffered a skull fracture on the back of her head, WHIO reported.
She also suffered other “complex” injuries caused by a “massive impact,” including a subdural hematoma, doctors said. A subdural hematoma is a “collection of blood between the covering of the brain (dura) and the surface of the brain,” according to MedlinePlus.
Two weeks later, on Dec. 19, Gardner died at the children’s hospital, the Montgomery County Coroners Office told WHIO.
Court records obtained by the outlet show that Mayor was charged with felonious assault and endangering children prior to the toddler’s death. Additional charges against him have not been filed.
Mayor is currently being held at Miami County Jail on a $1 million bond awaiting his next court date, per jail records viewed by PEOPLE.
The Montgomery County Coroners Office and Piqua Police Department did not immediately respond to PEOPLE’s request for comment. It is unclear if Mayor has legal representation to comment on his behalf.
