A father of three was fatally shot after calling 911 during an argument with a man spray painting a sidewalk.

The shooting of Kevin Doherty, 56, occurred just before 9 a.m. on Thursday, Aug 28 near Jordan Pond in Shrewsbury, Mass, just after he had dropped off his 6-year-old son at school.

Snehal Srivastava, 26, has been charged with armed assault to murder and carrying a firearm without a license.

He’s being held without bail, the Worcester County District Attorney’s office said.

According to the criminal complaint obtained by PEOPLE, Shrewsbury police officers responded to the Jordon Pond area after receiving a 911 call from Doherty that he was being attacked.

“Seconds later multiple gunshots, and Doherty saying, ‘He shot me,’ were heard on the open 911 line,” per the complaint. “Dispatchers were no longer able to speak with Doherty at this point.”

At the scene, officers found Doherty with multiple gunshot wounds. He was transported to UMass Medical Center where he died.

A witness allegedly told police he saw Doherty and a man, who was later identified as Srivastava, arguing about a scooter before Srivastava pulled out a gun, fired multiple rounds and fled the scene, according to the complaint.

Investigators allegedly found two photos on Doherty’s phone that were taken about a minute before he called 911. One of them showed the scooter and the other allegedly showed Srivastava wearing Nike Air Max style sneakers “holding a can of spray paint in his right hand and spray-painting the ground,” according to police.

Srivastava was taken into custody at his home. “At that time, Srivastava was wearing the identical pair of Nike Air Max sneakers that can be seen in the photograph from victim Doherty’s cell phone,” per the complaint.

According to the complaint, officers were called to the same area the day before after someone painted “Coolidge Street Crips” on the ground. The exterior of Srivastava’s residence also featured graffiti referencing the Crips, the complaint notes.

In a statement, Doherty’s fiancé Sarah Schofield said the two were scheduled to get married on Sept. 20. “No one should ever endure the trauma of canceling wedding arrangements only to make funeral ones,” she wrote, Boston.com reported. “This loss, and the fractures it created are so severe it makes healing seem impossible. 

“He was funny and he was kind. He truly woke up each morning with a smile on his face,” she wrote.

According to an online obituary, Doherty was an “avid music lover, passionate golfer, and enthusiastic hockey fan.”

“Known for his giving spirit, he was a friend to all and truly the life of every gathering—bringing laughter and chatter wherever he went,” the obituary read.
