A Utah man is said to have killed his son following an argument on Christmas Eve, in which he accused him and his fiancée of “withholding information” about his wife’s alleged affair.
Harold Luster has been charged with one count of first-degree murder and one count of armed criminal action, according to a news release from the Jefferson County Sheriff’s Office shared on Facebook.
Luster, 61, is currently in custody on a no-bond warrant, police said. He pleaded not guilty on Thursday, Dec. 26, KSDK reported.
The fatal shooting took place at around 8:55 p.m. local time on Tuesday, Dec. 24, per police. According to a probable cause affidavit obtained by The Sun Herald, Luster’s son Kevin Ward was visiting for the holidays with his fiancée.
Luster and Ward’s fiancée, whose identity has not been shared, got into an argument because the father believed his wife was cheating on him and he thought his son and his partner knew about the alleged affair, the outlet reported, citing the legal document.
During the altercation, Luster allegedly asked his son’s fiancée, “Do you wanna get shot?” per the Herald.
Ward, 26, then reportedly told his fiancée to get him a knife and told her that she should “call 911 if something happened” between him and his father, the outlet said.
As Ward’s fiancée began to leave, she heard him trying to calm his father down. “You’re not going to shoot her,” Ward said, to which Luster allegedly responded, “You want to get shot instead?” the Herald reported, citing the probable cause affidavit.
Luster then reportedly fired a single bullet into his son’s forehead, causing him to fall to the floor. He was pronounced dead at the scene, according to the Herald.
The investigation remains ongoing, Jefferson County Sheriff’s Office said. It is not immediately clear if Luster has legal representation to comment on his behalf.
