Haley Joel Osment was arrested for alleged public intoxication last week. 

The Sixth Sense actor, 37, was booked for alleged public intoxication and possession of an unidentified controlled substance on Tuesday, April 8, in Mammoth Lakes, Calif, Sergeant Jason Heilman confirmed to PEOPLE. “He was booked and is no longer in custody,” Heilman said.

TMZ was the first to report the news of Osment’s arrest. Representatives for the actor did not immediately respond to PEOPLE’s request for comment.

The Mono County Sheriff’s Office confirmed to PEOPLE that Osment was arrested by the Mammoth Lakes Police Department and provided a mugshot taken after the incident.

The Mono County district attorney will reportedly now decide whether or not to prosecute Osment’s case.

This isn’t Osment’s first brush with the law. In 2018, police were summoned when the actor had a public verbal scuffle at McCarran International Airport in Las Vegas on Super Bowl Sunday. 

In 2006, when he was 18, Osment was charged with misdemeanor drunk driving after he was injured in a car accident. He later pled no contest to one count of driving under the influence of alcohol and one count of possession of marijuana, and was sentenced to three years probation.

Osment costarred in last year’s Zoë Kravitz-directed Blink Twice. 

His sister, actress Emily Osment, shared an update on her Instagram that members of her family had lost their homes in the Los Angeles fires of early January. “It’s been an extremely difficult month. Thank you to everyone that has reached out to my family in the wake of the fires,” she wrote on Jan. 26.
