A former schoolteacher and cheerleading coach accused of sending a nude video of himself to a pair of underage girls in 2022 made an eyebrow-raising excuse in court this week.
Nicholas Moseby, who was arrested in Sept. 2022, on accusations he texted a video of his genitals to two girls aged 14 and 15, reportedly claimed in a Contra Costa County courtroom this week that the text was an accident and that he meant to text the video to a sex worker, the local East Bay Times reported.
“He talks to a lot of sex workers,” Moseby’s public defender Manisha Daryani told the court, according to the East Bay Times.
“All of us have phones, and all of us have accidentally texted the wrong person. It happens,” Moseby’s attorney added, according to the outlet.
Moseby, 44, was arrested on Sept. 14, 2022, and charged with three felonies: two counts of committing a lewd act upon a child, as well as another count for distributing or showing pornography to a minor, according to the Contra Costa County District Attorney’s Office.
The East Bay Times reported that since Moseby’s 2022 arrest, more alleged victims have come forward against the former educator, who now faces an additional charge of sexual battery.
Moseby — who was a biology teacher at San Ramon Valley High School before becoming a gym teacher at Diablo Vista Middle School in Danville, Calif., as well as a cheerleading instructor at Nor Cal Elites in San Ramon, Calif. — was arrested and placed in custody for roughly three months before posting a $200,000 bail in Dec. 2022, according to the local Danville San Ramon.

The ex-teacher pleaded not guilty to the charges against him, according to the outlet. The East Bay Times also reported that Moseby testified during his recent trial and denied the allegations once again.
According to the Danville San Ramon, Moseby’s criminal trial has been delayed eight times in recent years as both his attorneys and prosecutors from the district attorney’s office have requested more time to work on the case.
“Position of trust. Position of power. Abused for his own sexual pleasure,” Deputy District Attorney Jessica Murad said during her closing arguments this week, according to the newspaper.
Deliberations in Moseby’s criminal trial begin Tuesday, according to the East Bay Times.
