Illness Forces Postponement of Luigi Mangione’s Friday Court Hearing By Ben Brachfeld 162

Luigi Mangione’s Friday, Dec. 5, evidence supression court hearing has been postponed because he is sick, Judge Gregory Carro announced from the bench Friday morning.

Mangione, 27, accused of fatally gunning down UnitedHealthcare CEO Brian Thompson last December, is in court this week as he and his attorneys seek to exclude crucial evidence from his case in state court, where he faces a second-degree murder charge.

He was expected to appear Friday for the fourth day of hearings in Manhattan Supreme Court, but at about 9:45 a.m., Judge Carro announced from the bench that Mangione was “ill” and would not be coming to court.

Mangione’s attorney, Marc Agnifilo, had no comment when asked about his client’s illness.

The proceedings are expected to continue on the morning of Monday, Dec. 8.

Seven witnesses have testified in court over three days. The court has heard from prison guards who said they had wide-ranging conversations with Mangione while he was in solitary confinement in Pennsylvania.

Also taking the stand have been the police officers who arrested him as he munched on a Steak, Egg and Cheese McMuffin from McDonald’s.

The 911 call from the McDonald’s and police bodycam footage from his arrest and interrogation have been played in open court.

Mangione has stoically watched the footage of his final moments of freedom, registering little emotion as he chats with his lawyers, writes down notes and occasionally looks back at his fans who have packed the courtroom’s rafters each day.

Mangione has pleaded not guilty to murder charges at the state level, the focus of this week’s hearings, and federal level, for which he could face the death penalty.
