A grand jury on Tuesday, Aug. 26 declined to indict a man who tossed a submarine sandwich at a federal agent in Washington, D.C., sources confirmed to ABC News and New York Times.

Federal authorities accused 37-year-old Sean C. Dunn of throwing the sandwich at a Customs and Border Protection officer deployed at a popular nightclub and restaurant area in Northwest Washington, D.C., the Times reported, following the deployment of the National Guard to the nation’s capital and federalization of D.C.’s police force by the Trump administration.

Dunn, who was charged on Aug. 13, allegedly yelled, “F*** you! You f***ing fascists! Why are you here? I don’t want you in my city,” per charging documents, CBS News reported.

Dunn was later fired from his job as a paralegal with the Justice Department.

Nonetheless, federal prosecutors in the U.S. Attorney’s Office in Washington were unable to convince a grand jury to return an indictment against Dunn. Grand juries at the federal level almost unanimously vote to return indictments in cases before them, per the Bureau of Justice Statistics.

Federal prosecutors were also unable to convince three grand juries to indict Sidney Reid, who allegedly assaulted an FBI agent during an immigration operation in Washington, D.C., Reuters reported.

The charge against Reid was downgraded to a misdemeanor, per Reuters.

According to the Times, a preliminary hearing is scheduled for Dunn next week. There, a magistrate judge will determine if there’s probable cause that a crime was committed, the outlet reported.

Dunn’s attorney declined to comment. The D.C. U.S. Attorney’s Office could not be reached for comment.
