Lil Nas X Now Facing Felony Charges, Potential Years in Prison After Being Accused of Assaulting Police During Arrest By Marina Watts and Daniela Avila

Lil Nas X could potentially face years in prison after new felony charges were filed Monday following last week’s arrest and after he spent the weekend in jail.

The rapper and singer, born Montero Hill, appeared before a judge Monday morning, TMZ reports. Four felony charges have now been filed against the artist: Three counts of battery with injury on a police officer and one count of resisting an executive officer, the Los Angeles District Attorney’s Office confirms to PEOPLE. Arraignment is set for this afternoon in Van Nuys.

Per California penal code, convictions of felony battery on a police officer and resisting an executive officer can see jail time of up to three years, as well as a $10,000 fine, for each charge.

Lil Nas X, 26, was initially arrested and charged with a misdemeanor on accusations of assaulting a police officer in Los Angeles. He was also hospitalized for a possible overdose, though the spokesperson was unable to confirm.

A rep for Lil Nas X did not return PEOPLE’s request for comment.

A spokesperson for the Los Angeles Police Department told PEOPLE on Aug. 21 that officers responded to a call about the musician “nude in the street” just before 6 a.m. on Ventura Blvd. Lil Nas X went on to allegedly “batter an officer, so he was booked for battery on a [peace officer.]”

Following the arrest, he was taken to the hospital for treatment. PEOPLE can confirm that he had since been discharged and was booked on the misdemeanor charge around 11:22 a.m. on Aug. 21. The “Old Town Road” singer then spent the weekend in jail before his hearing and arraignment on Aug. 25.

Months before the musician was arrested, he opened up about his mental state in a video shared on X from a fan account.

“These last few years were pretty difficult for me,” he said, per a video shared by a fan account on X. “They have been pretty difficult for me.” Lil Nas X mentioned he felt like he had been “flaky” and “all over the place.”

He also told fans what about what they could expect from his music following the “pretty difficult” few years. “I’m just now, like arriving to this place of feeling confidence in myself and what I’m doing. And I’m trying to make sure I put intention towards my music and my vision and the creativity of it all.”

In March, the “INDUSTRY BABY” singer spoke to PEOPLE about his personal life and a new era of music.

“I wanna be myself more than ever this era,” he said at the time. “I want to be completely free out there, only doing the things that I wanna do. If I do not want to do it, I’m not doing it.”

Added Lil Nas X: “If I don’t want be there, I’m not gonna be there. I think it’s more important than ever to really stand in myself and my power and recognize where I’m taking my energy and where I don’t want to take it.”

He also said he felt in the past that he needed “everybody to like me before.” “When I started to let go of it more, I would still hold onto it. And now I’m here and I’m just… I’m showing up as me. I’m existing.”
