NEED TO KNOW

  • A federal judge denied Sean “Diddy” Combs’ bail for a fifth time
  • He was denied bail on account of being a risk of “flight or danger”
  • Combs will be sentenced on his conviction of transportation to engage in prostitution on Oct. 3

A federal judge denied Sean “Diddy” Combs’ bail in a new ruling on Monday, Aug. 4.

This marks the fifth time that Combs, 55, has been denied release from the Brooklyn Metropolitan Detention Center, where he has been held since his September 2024 arrest.

In court documents obtained by PEOPLE, Judge Arun Subramanian wrote that the court must “Find by clear and convincing evidence that the person is not likely to flee or pose a danger to the safety of any other person or the community if released,” and that Combs posed a risk of “flight or danger.”

The judge went on to reference the conditions that would be required to warrant Combs’ release, saying that these would be “‘Exceptional reasons’ warranting release where it was undisputed that the defendant posed no risk of flight or danger, and where ‘unique circumstances’ counseled release, including the defendant’s advanced ‘age and serious medical conditions, which require care that the MDC may not be able to provide.'”

Judge Subramanian concluded that Combs “fails to satisfy his burden to demonstrate an entitlement to release.”

The ruling comes days after Combs’ ex-girlfriend Virginia “Gina” Huynh, who was referred to as “Victim-3” in his indictment, wrote a letter to a New York judge asking for him to be released on bail.

In her letter, Huynh — identifying herself by name for the first time — advocated for Judge Subramanian to grant Combs bond to “allow him to continue caring for his family and fulfilling his responsibilities while still subject to the Court’s supervision.”

Combs’ attorneys previously asked the judge on July 28 to release him on a $50 million bond while he awaits sentencing for a July 2 federal conviction on charges of transportation to engage in prostitution. Judge Subramanian denied the request on Monday.

Also on July 2, Combs was acquitted of more serious charges of sex trafficking and racketeering conspiracy and his attorneys asked for his immediate release, which was also denied.

Combs was denied bail three times before his sex crimes trial began in May. He will be sentenced on Oct. 3 for his conviction of transportation to engage in prostitution.

By the sentencing date, Combs will have spent more than a year in jail, which will be credited to his ultimate sentence. He faces a maximum of 20 years in prison.
